Terms & Conditions

These terms and conditions (together the “Terms”) apply to all bookings made (each a “Registration”) in respect of a Art World Advisory Group (a “Course”). The person making the booking (“You”) undertakes to provide accurate and complete information during the Registration process, and the submission of a Registration by You shall constitute Your acceptance of these Terms in respect of that booking. Art World Advisory Group may modify these Terms for any reason and at any time.

1. Eligibility and Content

You must be 18 years of age or older to participate in a Course. You will need (and by completing a Registration You confirm that You hold) sufficient fluency in the language in which the Course is presented (which will be detailed in the booking information for the relevant Course). Art World Advisory Group makes no claim that any Course content is appropriate for any particular purpose or audience, or that You are entitled to access it from any location outside of the United Kingdom and/or the United States. Access to a Course may not be permitted by certain persons or in certain countries. When accessing a Course, You are responsible for compliance with the laws of the jurisdiction in which You are located. Art World Advisory Group reserves the right to remove You from the Course if You do not comply with these terms, or if you fail to respect Art World Advisory Group staff and/or fellow participants.

2. Payment and Registration

The full fee for the Course (the “Fee”) must be paid upon Registration and Your booking is not complete until Art World Advisory Group has received the Fee. You are responsible for any non-payment of the Fee, even if the Fee is being paid on Your behalf by a third party. After successful Registration, You will receive an e-mail from Art World Advisory Group acknowledging the receipt of the Fee and Your booking for the relevant Course. All Fees will be in British Pounds Sterling (GBP). Accepted payment methods are MasterCard, Visa or bank transfer. Your Registration is not transferrable to any other person under any circumstances.

3. Cancellations and Refunds

Cancellation by You
You have the right to cancel Your Registration for a Course or Tour at any time within 14 days of making Your booking. If You do cancel, You will receive a full refund of the relevant Fees, unless such cancellation is made after some or all of the relevant Course has been delivered, in which case You will receive a pro-rata refund in respect of those parts of the relevant Course that have yet to be delivered. It is not possible to replace individual sessions that you are unable to attend with sessions on a future Course.

To exercise Your cancellation rights as set out above, please inform us by email (to insert Art World Advisory Group email address). Please write the name of Your Course /Tour in the subject-line of Your email. You may use the cancellation form provided below if You wish, but You are not required to do so.

This cancellation right is provided to you in line with the Consumer Rights Directive (2011/83/EU) but applies regardless of whether You are a buyer located in the EU acting as a consumer and not for business purposes. If You exercise Your right to cancel Your Registration for a Course at any time after the periods described above, You will not be entitled to a refund, except in exceptional circumstances, which will be entirely at the discretion of Art World Advisory Group. If a refund is granted to You in these circumstances, an administration fee may be charged.

Cancellation by us

Art World Advisory Group reserves the right to cancel a Course (or any part thereof) by giving You notice in writing (including by email) at any time before the course is due to start. Art World Advisory Group will refund the Fees (or the relevant proportion thereof, if part of the Course has been delivered) paid by You and, if possible, will endeavour to offer a transfer to another Course as an alternative, subject to payment or refund of any difference in the Fee for the relevant Course(s). Art World Advisory Group liability when it cancels a Course (or any part thereof) will be limited to a refund of the Fees (or the relevant proportion thereof) paid by You in respect of the relevant Course. All Course dates are subject to change; however, notice of such change will be given as soon as possible and refunds may be issued in our discretion for any rescheduled element(s) of a Course if You are unable to attend the revised date.

4. Course Content

The Course description is intended to indicate only the general nature of the Course and its subject matter and does not guarantee the inclusion of any particular content. Art World Advisory Group reserves the right to amend the Course and alter specific details in relation to the Course and its content at its sole discretion and at any time. Art World Advisory Group is not responsible if You fail to pass any assessment and/or meet any requirements in relation to any Course, and You should ensure that You are available to attend, and/or allocate sufficient time to allow You to prepare for and complete, the relevant Course. Refunds will only be provided as set out in paragraph 3 above.

5. Access to Materials and Conduct

Art World Advisory Group grants You a limited license to view, access and use the content located via the Course and any platform through which the Course is delivered in connection with the Course You are enrolled in. As a condition of such license, You agree:

i.that all materials (including but not limited to text, photographs, video, audio, images and any other content) appearing via the Course or provided by Art World Advisory Group in connection with it are protected by copyrights and/or other proprietary rights belonging to Art World Advisory Group and/or other third parties;

ii.that You will abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in the United Kingdom and the United States and any other jurisdiction from which You are accessing the course;

iii.that You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, record or in any way exploit any content of or from the Course;

iv.that You may not sell or offer for sale any of the content, or allow third parties to access or use it, or use such content to construct any kind of database; and

v.to only access and/or use the content from the Course for personal, non-commercial use.
Any violation of these terms may result in Your expulsion from the Course, and You may be subjected to legal action which may result in fines and/or penalties. You agree that you will take all reasonable steps to maintain the security of any username and/or password (together “Access Information”) or other access details required for accessing the Course, and that You will notify us promptly if You become aware of any unauthorized use of Your Access Information.

6. Data Protection and Recording

By registering with Art World Advisory Group and by paying the fees, You agree to Art World Advisory Group collecting and using Your personal data. This will be done in accordance with the Data Protection Act 2018 and Art World Advisory Group privacy policy. The Privacy Policy may be updated at any time. Art World Advisory Group may make video or audio recording of any Course(s). In such circumstances, attendees shall not automatically be visible on screen or in such recording, and shall only be able to submit queries during the course anonymously. However, if You choose to contribute to the discussion, such audio contribution may be captured on the recording, and You hereby acknowledge and agree that Art World Advisory Group shall be entitled to use such recording for distribution to attendees of the relevant Course(s).

7. Technology Requirements

Courses are provided through various online platforms and applications. It is Your responsibility to ensure that You are able to meet the proper hardware and/or software requirements (including but not limited to any videoconferencing or similar remote access software and/or applications as may be detailed in the booking information for the relevant Course) (together “Required Tools”), along with access to the internet with an appropriate fast connection, to be able to participate in the relevant Course. If you access a course by way of any such Required Tools, you acknowledge that such tools may maintain a record of Your attendance at the relevant Course, which may be retained in accordance with the Privacy Policy. Art World Advisory Group is not be responsible for any errors or failures in relation to Your ability to access the Course or any related materials, including where such errors or failures are caused by: (i) a loss and/or interruption of internet connectivity; (ii) any hardware and/or software issues and/or (iii) a breakdown or problems with Your computer or system.

8. Miscellaneous

Your contract with Art World Advisory Group and any dispute arising from it (including non-contractual disputes) shall be governed by and enforced pursuant to the laws of England. Any dispute, controversy or claim arising out of, relating to, or in connection with these Terms or the breach, termination, interpretation or validity thereof (the “Dispute”) shall be subject to the jurisdiction of the courts of England and Wales. Should a situation arise that is not covered by these Terms, Art World Advisory Group reserves the right to take any reasonable and fair action that we think appropriate in the circumstances.
